U.S. Secretary of Education Duncan comes to Twin Cities for early ...

U.S. Secretary of Education Arne Duncan will be in the Twin Cities Tuesday for several events, including a town hall forum with Gov. Mark Dayton on early learning.

The governor's office says Duncan's visit is scheduled to focus on the need for investment in early-childhood education.

And, notes the governor's office, the state's new budget provides an additional $600 million in E-12 education, including $40 million for early-learning scholarships?that will help more than 8,000 Minnesota kids attend high-quality child care and preschool. The budget also provides $134 million to help provide?free all-day kindergarten, and there is $40 million in new funding for special education.

Duncan's Tuesday events are:

9 a.m., classroom visit to Pond Early Childhood Family Center, Bloomington

9:30 a.m., Early-learning town hall forum at Kennedy High School, Bloomington. Scheduled to be on the panel with Duncan are:

  • Gov. Dayton
  • Minnesota Education Commissioner Brenda Cassellius
  • Maj. General Richard C. Nash, adjutant general, Minnesota National Guard
  • The Rev. Peg Chemberlin, executive director, Minnesota Council of Churches

Judo Payments Secures $5M For Its Mobile-Focused Card Processing Platform

European players in this space include Monitise, Paddle, ValidSoft and left-of-field startups like Droplet. However despite operating in the UK since July last year it wasn't known how one of the newer arrivals, Judo Payments, was backed. Founder/CEO Dennis Jones says that it launched with an initial $5M seed round. Terms were undisclosed but it's understood the round was led by a New York based private investor which previously backed Euroffice and PaymentSense, both UK startups. The startup has now come out of a year long beta with some 2,500 merchants on its platform who pay on a subscription basis.

JVC launches flagship BlackSapphire XL HDTV line with builtin WiFi, passive 3D

JVC's been trying to get back into the HDTV game via its recent partnership with Vizio maker Amtran, and just took another big step by unveiling the flagship BlackSapphire SL series. The new models boast high-end touches like tiny bezels, ultra-thin profiles and an edge-lit LED "adaptive backlight." You'll also get built-in WiFi, SmartTV with apps like Netflix, Pandora and a Slingbox client, Xinema-Sound audio with simulated surround-sound, and passive 3D with four sets of included glasses. Interestingly, JVC decided to launch the series with rather small 42-inch and 47-inch models, though Amtran told CNET that larger sizes are also in the works. Also unusual in a flagship is three-digit pricing: $799 for the smaller SL42B-C and $899 for the SL47B-C. Considering the sticker shock we've had lately, however, we're all for keeping things small in that regard. Both models will be up for grabs later this summer.

Khan: Jaguars 'are the home team for London'

Jaguars owner Shad Khan is the newest owner of the Fulham Football Club, having purchased the London-based soccer club on Friday. One of the benefits of being a billionaire sports owner is the ease of travel involved, and Khan has already scooted across the pond to announce the purchase.

While waiting for the official Sunday announcement, he spoke with Fulham TV about the purchase of the club and his plans for the future. As you might imagine, there was some discussion of the Jaguars. Khan called the club a "civic asset" in the same vein as Fulham.

"I've always looked at the other association I have with the Jacksonville Jaguars is really they're a civic asset," Khan said. "I am the steward of that asset. And I feel very much the same thing here. We want to listen to the fans."

But he also called the Jags "the home team for London," noting the "commonality" between the Jaguars and Fulham.

"First of all, the Jacksonville Jaguars and Fulham operate as two entities," Khan said when asked about the similarities between American and European football. "Obviously, there would be some practices, some synergies we'd like to take advantage of. And the Jaguars will be playing one home game [here] for the next four years.

"So, we are the home team for London. So, there is some commonality there."

Personally, I think the Jags will stick in Jacksonville, but there are many folks who don't believe that. And Khan's purchase of Fulham -- a soccer club not located in Jacksonville -- has many folks believing the Jags could bounce for London.

It's certainly a possibility, though it seems less likely with Khan and Jacksonville pumping millions into Everbank Field. Calling Jacksonville a "home team" for London seems like a cause to get all up in arms about the way it's being referenced.

The reality is Jacksonville is the home team for London. They're playing overseas for several years in a row and Khan is trying to market them internationally. Building a brand relationship between Fulham and the Jaguars will only improve the international recognition of both his football teams.

Ex-Penn State president Spanier sues Freeh

HARRISBURG, Pa. -- Penn State's former president Graham Spanier initiated a libel and defamation case Thursday against Louis Freeh, the former FBI director who a year ago produced a report for the school that was highly critical of Spanier's role in the child sex abuse scandal involving longtime assistant football coach Jerry Sandusky.

Paperwork filed in Centre County, where the school is located, disclosed little about the nature of his claims but checked off a box on a court system form that described the case as "slander/libel/defamation."

The filing was made one day before the one-year anniversary of Freeh's report, which concluded that Spanier, late coach Joe Paterno and other high-ranking Penn State administrators failed to protect children against Sandusky. Under Pennsylvania law, those who believe they have been libeled or defamed have a year to initiate a civil lawsuit.

Calls and emails seeking comment from Freeh and from Spanier lawyer Elizabeth Ainslie were not returned. Along with Freeh, the paperwork also names as a defendant the law firm where Freeh works.

The Freeh report said Spanier told Freeh's investigators that he never heard anyone say Sandusky was sexually abusing children. But Freeh wrote it was more reasonable to conclude that Spanier, Paterno, athletic director Tim Curley and vice president Gary Schultz "repeatedly concealed critical facts relating to Sandusky's child abuse from the authorities, the university's board of trustees, the Penn State community and the public at large."

Curley, who was placed on leave to serve out his contract, and Schultz, now retired, were both charged in November 2011, when Sandusky was arrested, and accused of perjury and failure to properly report suspected abuse.

Spanier was forced out as president at that time, and a year later was himself charged as part of an alleged cover-up of complaints about Sandusky. A school spokesman said Thursday Spanier remains a faculty member on administrative leave.

Paterno died of complications from lung cancer in January 2012 and was not charged with any crime. The Freeh report's scathing conclusions about the former coach was followed more than a week later by the school administration's decision to remove his statue from outside the football stadium.

Additional charges were also filed against Curley and Schultz last November, but there has not been a preliminary hearing yet because of a legal dispute about the role played in the grand jury proceedings by Cynthia Baldwin, a former state Supreme Court justice who at the time was Penn State's top lawyer.

On Tuesday, a district judge in the Harrisburg suburbs announced the preliminary hearing would be held for Spanier, Schultz and Curley starting July 29 in the county courthouse. The hearing will determine if there are grounds to forward the case to county court for trial. All three men have vigorously denied the allegations against them.

Sandusky, 69, was convicted of 45 counts of child sexual abuse, including violent attacks on boys inside school facilities, after a three-week trial last summer in which eight victims testified against him. He is serving a 30- to 60-year prison term and maintains he was wrongfully convicted. He is pursuing appeals.

Bungie Day: Celebrate Bungie's Self-Made Holiday With Some Halo ...


Gaming is chalk full of traditions. Whether it be the big stuff, like showing up to a midnight launch for your favorite game, or the small stuff, like tea bagging a downed opponent. You can expect gamers devoting themselves to nostalgia or bias on any given day. Today, if you?re a Bungie or Halo fan, you may be ready to celebrate a tradition of your own.

As today marks one more in a long line of Bungie Days.

A holiday that started in 2007, it was Bungie?s way of saying thank you to the fans. They did this through a number of ways, like exclusive goodies or game announcements that were quite a treat at the time. Bungie also encouraged everyone who?s anyone to enjoy them a flag capturing good time of Halo.

Well, Bungie Day has come around, ?and once more we are reminded of how Bungie has helped to change gaming with their own brand of video game awesomeness.

While it may be true that Halo now falls under the duties of 343 Industries, that doesn?t mean we are so soon to forget the decade long contribution Bungie made to the franchise. A special interview with the creator of Halo, Jason Jones, sees the Bungie mastermind regale gamers with stories about the original Halo, and the legendary power of the Halo 1 pistol.

The interview is a three parter, so expect the next two parts of the interview in the days to come. This years Bungie Day is of a slightly different nature, as the event has stretched into a week long affair. ?Bungie Day? week technically started on the 2nd, with Bungie revealing and announcing a whole host of top notch swag and goodies for any fans of their studios.

Realistic robot carp created: First robot fish with autonomous 3-D movement in Asia

June 26, 2013 ? A team of researchers from the National University of Singapore's (NUS) Department of Electrical & Computer Engineering has developed a robot fish that mimics the movements of a carp. This robot which is essentially an autonomous underwater vehicle (AUV) is ready for applications, as it can be programmed to perform specific functions, for example, for underwater archaeology such as exploring nooks and corners of wreckage -- or sunken city which are difficult for divers or traditional AUVs to access. Other applications include military activities, pipeline leakage detection, and the laying of communication cable.

The team comprises Professor Xu Jianxin, Mr Fan Lupeng, graduating Electrical Engineering student and Research Fellow, Dr Ren Qinyuan. Mr Fan worked on the project for his final year which won the High Achievement Award at the Faculty's 27th Innovation and Research Award. It will also be featured at the IEEE/RSJ International Conference on Intelligent Robots and Systems, a top international conference on intelligent robots, in Tokyo on 3-7 November 2013.

Said Prof Xu, "Currently, robot fish capable of 2-D movements are common, meaning that these models are not able to dive into the water. Our model is capable of 3-D movements as it can dive and float, using its fins like a real fish. Compared to traditional AUVs, they are certainly more mobile, with greater manoeuvrability. If used for military purpose, fish robots would definitely be more difficult to detect by the enemy."

Fish robots are also quieter and consume less energy, compared to traditional AUVs. Said Mr Fan who studied the movements of real life carps for three months, in order to develop their robot, "We chose to study carps because most fish swim like them. There is no literature at all on designing a mathematical model on the locomotion of fish and so we had to start from scratch. We used a camera to capture all the possible movements of a carp and then converted the data mathematically so that we could transfer the locomotion of real carp to our robot using different actuators."

This has been most challenging as fish use a lot of different muscles to move, and many actuators are required to enable the robot to move in the same manner.

Added Dr Ren, "Some fish can achieve almost 180 degree turning in a small turning radius through bending their body while traditional underwater vehicles have a much larger turning radius. Hence it is quite a feat for us to achieve this movement in our robot fish."

Other challenges included waterproofing the fish body, the motor and the control box. The fins and tails also need to be flexible and the team decided to use very fine (1mm) acrylic board for these. Buoyancy and balance for the robot is maintained by using plastic foams attached to both sides. For the diving mechanism, their robot fish is equipped with an internal ballast system to change density. The system is sophisticated enough to enable the fish to dive suddenly, as well as to the precise depth intended.

The team has constructed two fish robots. The larger prototype is about one and half metres in length, weighing about 10kg and it can dive to a depth of 1.8 metres. The smaller robot is about 60 centimetres long and weighs a mere 1.5kg. "To my knowledge, the world's smallest fish robot is one about 12.7 centimetres (5 inches) in length. It was designed by MIT for specific military purpose and could go to a depth of 1.5 metres," said Dr Ren.

Moving forward

Underwater vehicles have long gone past the days of the submarines, said Mr Fan. Fish robots, besides being a micro submarine, can also be fully autonomous and can be programmed to perform many difficult and dangerous tasks.

The team hopes to make their robot fish even smaller and more realistic. Said Mr Fan, "We intend to equip it with more sensors like GPS and video camera to improve autonomous 3-D movement. We also intend to test out our fish with more challenging tasks such as object detection."

UK banks' insurance bill tops 10 billion pounds and rising

LONDON (Reuters) - Britain's banks have paid out more than 10 billion pounds for mis-selling loan insurance, the Financial Conduct Authority said on Thursday, and the bill is rising with no deadline set for claims.

Separately, the FCA said it will levy a hefty fine next month on a firm for poor handling of complaints about insurance it sold to cover the loss or theft of mobile phones.

The FCA - launched in April after the financial crisis convinced legislators the Financial Services Authority was too lenient a regulator and had to be scrapped - is mandated to protect consumers and end years of mis-selling products.

It said banks have paid 10.1 billion pounds to customers hit by the country's biggest financial mis-selling scandal. Compensation is still being paid out at the rate of about 400 million pounds a month.

The Bank told five British banks last week to increase their capital buffers by a collective 13 billion pounds by December, partly because of the rising bill for mis-selling payment protection insurance (PPI).

Banks have made PPI provisions of about 14 billion pounds and had hoped that the FCA would set a deadline for claims, but talks with the regulator broke down.

In a review of mobile phone insurance (MPI), the watchdog said there is a gap between what the customer expects from a policy and what it gets from a sector dominated by nine, unnamed firms.

Some products were not designed to meet customers' needs, terms and conditions were unclear and unfair, and claims were poorly handled, the FCA said.

"Although the costs of MPI are relatively low, with premiums for some policies as little as a few pounds a month, the product is widely held with over 10 million customers," the FCA said.

One man lost his phone in the back of cab and made a claim after being unable to recover it, but it was rejected on the basis he'd left the phone unattended in a public place.

Another claimant was rejected because of "mis-use" of his phone - it had not been used in the last two weeks.

"We have begun communicating the findings to the firms that took part in the review and they are making improvements," FCA director of supervision, Clive Adamson said.

The review is the latest example of how the regulator is stepping in earlier and scrutinising the products themselves more closely, compared with looking at sales practices in the past long after evidence of mis-selling had emerged.

Never turn your back on a lemur ? especially if it?s a member of a big gang.

Lemur species that live in large groups can tell when to steal food from a competitor in a lab experiment, researchers report June 26 in PLOS ONE. The finding supports the idea that brain power in primates evolved to fit their complex social lives. Because the sneakier lemurs have the same size brains as less-sneaky ones living in smaller groups, researchers suggest that social smarts don?t always depend on brain size.

Much of the evidence for sociality?s role in the evolution of intelligence comes from indirect measures such as brain size, says study coauthor Evan MacLean of Duke University. But brain size does not always correspond to brain power, so MacLean uses behavioral tests.

He and his colleagues tested the social intelligence of six species of lemurs, primates from Madagascar distantly related to monkeys and apes. Each of the species lives in social groups ranging from families of just three, mongoose lemurs? preferred posse, to gangs of about 16, a typical size for a group of ring-tailed lemurs.

The researchers trained lemurs to view humans as competitors for food, then presented the animals with a choice between pilfering treats from one of two people: one facing the animals or another with his or her back turned. Species that live in small groups reached for the food under a competitor?s nose as often as they did behind people?s backs. But the ring-tailed lemurs were much more likely to choose the unguarded food.

Most intriguing, says Susanne Shultz, a biological anthropologist at England?s University of Manchester, is that group size was much better than brain size at predicting which species would perform well in either the social intelligence test or in a separate nonsocial intelligence test. ?We assume that if you have a bigger brain you should be better at solving problems,? she says. Her own research suggests that brain size in primates does correspond to cognitive ability, but she used a different set of intelligence tests and more kinds of primates. She says she would be interested to see how other species perform on MacLean?s tests.

MacLean agrees that a general relationship probably exists between brain size and cognition. But he speculates that this might not be the case with very closely related species like the lemurs. ?Cognition might evolve a little bit ahead of brain size,? he says.

In pre-trial training, a ring-tailed lemur learns that a person watching is a competitor for a morsel of food. The animal then chooses to take food from behind a person?s back, rather than from a watchful person.

Bison may shrink as planet warms, study says

Bison roaming the U.S. prairie may grow smaller as a result of climate change, a new study suggests.

Interested in how regional climate affects bison?size, biologist Joseph Craine of Kansas State University collected body mass data for more than 250,000 bison across the country. He found that herds from hot, dry regions tend to weigh less than those from cooler, wetter regions. The average South Dakota adult male bison, for example, weighed roughly 1,900 pounds (860 kilograms), whereas the average Oklahoma adult bison ? subject to hotter conditions ? weighed closer to 1,300 pounds (590 kg), Craine reported last week in the journal PLOS ONE.

"The difference in temperature between those two states is around 20 degrees Fahrenheit (11 degrees Celsius), which is about three times the projected increase in temperatures over the next 75 years," Craine said in a statement. "That's a pretty extreme difference and beyond the worst-case scenario. But it is a clear indicator that long-term warming will affect bison, and is something that will happen across the U.S. over the next 50-75 years."

Craine thinks this size discrepancy results from differences in grass quality. Grasses in warm, dry regions tend to contain less protein than those in cooler, wetter regions. Protein deficiency slows bison growth early in life, resulting in smaller adults.

Other grazers, like cattle, will likely face similar changes in a warming climate, Craine said. Though more work is needed to predict the extent of warming on the prairie, Craine suggests that the cattle industry could face losses of more than $1 billion within the next 75 years as a result of degrading grass quality.

Knee Replacement Often Beneficial for Rheumatoid Arthritis: Study ...

Patients did as well as those with osteoarthritis, but same did not hold true for hip replacement

THURSDAY, June 20 (HealthDay News) -- The common belief that rheumatoid arthritis patients don't benefit from knee replacement surgery as much as those with the more common osteoarthritis has been challenged by the findings from a pair of studies by New York City scientists.

Researchers from the Hospital for Special Surgery also found, however, that rheumatoid arthritis patients who underwent a total hip replacement didn't fare as well as those with osteoarthritis, though they did experience improvements in pain and function.

"One thing that we can clearly pull out of this research is that the levels of pain and function among those with rheumatoid arthritis were so much worse preoperatively at the point they approached joint replacement," explained rheumatologist Dr. Susan Goodman, the lead author of both studies. "They may be postponing or not getting to surgery until they're really in a much worse state. Perhaps that's one of the explanations for the results . . . perhaps it's their generalized disease. We really just don't know yet."

Goodman presented the research last week at the European League Against Rheumatism's annual meeting in Madrid, Spain. Research presented at scientific conferences has typically not been peer-reviewed or published and is considered preliminary.

Affecting one of every five adults, along with 300,000 children, arthritis is the leading cause of disability in the United States, according to the Arthritis Foundation. Osteoarthritis, the most prevalent form, progressively breaks down cartilage in the joints due to wear and tear, while rheumatoid arthritis is an autoimmune disease marked by inflammation of the membranes surrounding joints. Along with bringing chronic pain, both types can result in joint destruction.

Historically, rheumatoid arthritis patients have had worse outcomes after joint replacement surgeries than osteoarthritis patients, according to the study authors, but more effective drugs developed over the last two decades have helped them to better control their disease.

In the first study, Goodman and her team analyzed joint replacement registry data to identify 178 rheumatoid arthritis patients and more than 5,200 osteoarthritis patients who underwent knee replacement surgery. Though rheumatoid arthritis patients had worse pain and function before surgery, patients in both groups had similar satisfaction rates after surgery.

The second study compared outcomes of 202 rheumatoid arthritis patients and more than 5,800 osteoarthritis patients who underwent hip replacement, finding that those with rheumatoid arthritis started out with worse function before surgery and also had worse pain and function scores after surgery. However, rheumatoid arthritis patients were as likely as those with osteoarthritis to experience an overall improvement after hip replacement, though the gains didn't erase the disparity between the two groups.

"The advice to rheumatoid arthritis patients is, really, that you will have significant pain relief [from joint replacement surgery]," Goodman said. "It is an area that needs more study. We're looking forward to assessing more rheumatoid-specific factors."

The research, which looked at participants with active rheumatoid arthritis, is consistent with what Dr. Olivia Ghaw, an assistant professor of medicine in rheumatology at Mount Sinai Medical Center in New York City, sees in her practice.

But Ghaw said she felt the study's two-year follow-up period was perhaps not long enough to confirm if the joint replacement outcomes remained positive for rheumatoid arthritis patients.

"For some of my patients, if their joint is severely destructed, I still do recommend joint replacement," she said. "Ideally, we would love to get their underlying disease under better control. If we can bring their inflammation down, perhaps they can have better results with joint replacement."

Russia caught bomb suspect on wiretap

WASHINGTON (AP) ? Russian authorities secretly recorded a telephone conversation in 2011 in which one of the Boston bombing suspects vaguely discussed jihad with his mother, officials said Saturday, days after the U.S. government finally received details about the call.

In another conversation, the mother of now-dead bombing suspect Tamerlan Tsarnaev was recorded talking to someone in southern Russia who is under FBI investigation in an unrelated case, officials said.

The conversations are significant because, had they been revealed earlier, they might have been enough evidence for the FBI to initiate a more thorough investigation of the Tsarnaev family.

As it was, Russian authorities told the FBI only that they had concerns that Tamerlan and his mother were religious extremists. With no additional information, the FBI conducted a limited inquiry and closed the case in June 2011.

Two years later, authorities say Tamerlan and his brother, Dzhohkar, detonated two homemade bombs near the finish line of the Boston Marathon, killing three and injuring more than 260. Tamerlan was killed in a police shootout and Dzhohkar is under arrest.

In the past week, Russian authorities turned over to the United States information it had on Tamerlan and his mother, Zubeidat Tsarnaeva. The Tsarnaevs are ethnic Chechens who emigrated from southern Russia to the Boston area over the past 11 years.

Even had the FBI received the information from the Russian wiretaps earlier, it's not clear that the government could have prevented the attack.

In early 2011, the Russian FSB internal security service intercepted a conversation between Tamerlan and his mother vaguely discussing jihad, according to U.S. officials who spoke on condition of anonymity because they were not authorized to discuss the investigation with reporters.

The two discussed the possibility of Tamerlan going to Palestine, but he told his mother he didn't speak the language there, according to the officials, who reviewed the information Russia shared with the U.S.

In a second call, Zubeidat Tsarnaeva spoke with a man in the Caucasus region of Russia who was under FBI investigation. Jacqueline Maguire, a spokeswoman for the FBI's Washington Field Office, where that investigation was based, declined to comment.

There was no information in the conversation that suggested a plot inside the United States, officials said.

It was not immediately clear why Russian authorities didn't share more information at the time. It is not unusual for countries, including the U.S., to be cagey with foreign authorities about what intelligence is being collected.

The FSB said Sunday that it would not comment.

Jim Treacy, the FBI's legal attache in Moscow between 2007 and 2009, said the Russians long asked for U.S. assistance regarding Chechen activity in the United States that might be related to terrorism.

"On any given day, you can get some very good cooperation," Treacy said. "The next you might find yourself totally shut out."

Zubeidat Tsarnaeva has denied that she or her sons were involved in terrorism. She has said she believed her sons have been framed by U.S. authorities.

But Ruslan Tsarni, an uncle of the Tsarnaev brothers and Zubeidat's former brother-in-law, said Saturday he believes the mother had a "big-time influence" as her older son increasingly embraced his Muslim faith and decided to quit boxing and school.

After receiving the narrow tip from Russia in March 2011, the FBI opened a preliminary investigation into Tamerlan and his mother. But the scope was extremely limited under the FBI's internal procedures.

After a few months, they found no evidence Tamerlan or his mother were involved in terrorism.

The FBI asked Russia for more information. After hearing nothing, it closed the case in June 2011.

In the fall of 2011, the FSB contacted the CIA with the same information. Again the FBI asked Russia for more details and never heard back.

At that time, however, the CIA asked that Tamerlan's and his mother's name be entered into a massive U.S. terrorism database.

The CIA declined to comment Saturday.

Authorities have said they've seen no connection between the brothers and a foreign terrorist group. Dzhohkar told FBI interrogators that he and his brother were angry over wars in Afghanistan and Iraq and the deaths of Muslim civilians there.

Family members have said Tamerlan was religiously apathetic until 2008 or 2009, when he met a conservative Muslim convert known only to the family as Misha. Misha, they said, steered Tamerlan toward a stricter version of Islam.

Two U.S. officials say investigators believe they have identified Misha. While it was not clear whether the FBI had spoken to him, the officials said they have not found a connection between Misha and the Boston attack or terrorism in general.

Matt Mitrione?s suspension is already over

UFC heavyweight Matt Mitrione was suspended on April 8 for his transphobic comments about trans fighter Fallon Fox. At the time, the UFC said they were "appalled" by his comments and said his words were "wholly unacceptable."

Yet now, on April 25, Mitrione is off suspension and has a fight scheduled. Mitrione will fight fellow "The Ultimate Fighter" castmember Brendan Schaub on the July 27 UFC on Fox 8 show.

122 days passed between Mitrione's last two fights. By the time he gets in the cage with Brendan Schaub at UFC on Fox 8, 112 days will have passed since his knockout of Philip de Fries. How is that a suspension?

Here we have the problem with MMA and suspensions. This isn't like football or basketball, where every athlete has the same amount of events, and a suspension of five games means the same thing for everyone. In MMA, some fighters fight once a year. Some fight four times a year. For a suspension to mean anything, it has to be for several months, and a fighter's ability to get in the cage must be affected.

Analysis: North Korea's epic drama - stage now set for next act

SEOUL/WASHINGTON (Reuters) - If North Korea's bellicose rhetoric threatening the United States and South Korea with nuclear war was aimed at dragging Washington to the negotiating table, it has likely failed.

Pyongyang may once again feel it needs to up the ante.

Two months of shrill threats following the North's nuclear test in February appeared at times to drag the Korean peninsula close to war as its young leader celebrated a year in power with a fusillade of verbal aggression that has now died down.

North Korea has made it clear it will not talk unless its right to a nuclear deterrent - its "treasured sword" - is recognized by the United States, while Washington insists any talks would be conditional on denuclearization.

That may lead to Pyongyang staging a new long-range rocket launch - which critics say is designed to prove missile technology - or a fourth nuclear test, or a small-scale military confrontation with South Korea in a bid to force talks and perhaps split Seoul from Washington.

"The difference in positions between the United States and North Korea is greater than ever," said Chun Yung-woo, South Korea's former national security advisor who left office in February and took part in framing U.N. sanctions on North Korea for its nuclear test that month.

Chun took part in meetings with North Korean negotiators as part of "six-party talks", a series that ran from 2003 among the two Koreas, China, the United States, Japan and Russia that were aimed at stemming the North's progress towards a nuclear bomb. He participated in talks in 2006 and in 2008, the last round.

The North has said it wants the United States to sign a formal peace treaty formally ending the 1950-53 Korean War, an end to U.N. sanctions and a pledge from Washington and Seoul not to attack it, as well as nuclear recognition.

"It has become much more difficult to seek common ground and find the right conditions for talks," said Chun, referring to the preconditions set out by Pyongyang.

North Korea has a long history of spurning engagement and trust-building measures. During the six-party talks, it agreed to abandon all of its nuclear weapons programs in 2005, only to stage nuclear tests in 2006 and 2009 as well as this year.

As recently as last year, it said it would allow nuclear inspectors back into the country, not launch any long-range rockets and go back to talks in exchange for U.S. food aid.

Just a few weeks later as Kim Jong-un formally took power, it undertook another rocket launch, scuppering the deal.

The lack of trust and verification means that once bitten, President Barack Obama is unlikely to fall for a second North Korean ploy, especially after crude propaganda films depicted the United States in flames from a North Korean attack.

"Because it is North Korea, the decision goes all the way to the Oval Office and I just don't see President Obama wanting to make any investment in this," said Victor Cha, formerly President George W. Bush's top advisor on North Korean affairs.

CHINA CARD?

Beijing is North Korea's one ally and could provide a route back into talks, although it too has expressed its frustration with the North's young leader.

When Kim Jong-un took office, there were hopes he would break with his father's push for nuclear weapons and embark on Chinese-style economic reforms.

But a year later, the young leader has still not paid a visit to Beijing. And instead of reforming, he has spent the past year purging the military and shuffling his close advisors. He has now staged two long-range rocket launches and one nuclear test.

"China is not very happy with Kim Jong-un for creating trouble," a source with close ties to Pyongyang and Beijing said.

"Kim Jong-un has been testing his control over the military through mobilization, but he overdid it."

Despite Beijing's displeasure, the young Kim may feel he has little more to lose.

Most analysts say that despite agreeing to sanctions on North Korea after February's nuclear test, Beijing will not economically strangle a client state that provides a buffer between it and U.S. forces stationed in South Korea.

South Korea's new President Park Geun-hye will meet Obama in Washington on May 7, providing the North with something it could use as another leverage point for a missile launch, nuclear test or other show of military strength.

North Korea carried out its February nuclear test just as Park was about to take office and as new U.S. Secretary of State John Kerry took up his post. The test also came at around the time of leadership transitions in Tokyo and Beijing.

"The reason things calmed down over the past 10 days or so ... was not bluster fatigue setting in, or not deciding strategically to tone things down now after having been on the rampage for so long, but more to catch their adversaries off their guard," said Sung-Yoon Lee, Professor of Korean Studies at the Fletcher School at Tufts University in the United States.
